Welcome to LoanSnap. These Terms of Service ("Terms") govern your access to and use of the LoanSnap website, mobile application, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

4.3. Approval and Funding: Loan approval is subject to our underwriting criteria and is not guaranteed. If your loan is approved, the terms of your loan will be governed by a separate loan agreement that you will be required to review and accept.

5. Fees and Payments

5.1. Loan Fees: Any fees associated with your loan will be disclosed in your loan agreement. These may include origination fees, late payment fees, and insufficient funds fees.

5.2. Payment Obligations: You agree to make all payments in accordance with the terms of your loan agreement. Failure to make timely payments may result in late fees, negative credit reporting, and other consequences as outlined in your loan agreement.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations
• Providing false or misleading information
• Attempting to access, tamper with, or use non-public areas of our Services
• Circumventing any security measures or access restrictions
• Using our Services for any fraudulent or illegal purpose
• Interfering with the proper operation of our Services

• Using our Services to transmit any malware, viruses, or other harmful code

9.2. No Guarantees: LoanSnap does not warrant that the Services will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LoanSnap, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.

11. Indemnification

You agree to indemnify, defend, and hold harmless LoanSnap, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your use of the Services or violation of these Terms.

12. Termination

12.1. By You: You may terminate your account at any time by contacting us. Termination of your account does not relieve you of any payment obligations under any existing loan agreement.

12.2. By Us: We may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

13. Changes to Terms

We may modify these Terms at any time by posting the revised Terms on our website. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in New York County, New York.

15. Dispute Resolution

17. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and LoanSnap concerning the Services.
